Terms of Service & Legal Disclaimers

Jobcard Financial LLC, a California limited liability company ("Jobcard Financial," "Company," "we," "us," or "our")
1. Scope of Services
Jobcard Financial LLC provides outsourced bookkeeping, controller services, financial reporting, and related financial management services ("Services") to trade contractors and service businesses. Our Services include, but are not limited to, transaction categorization, bank reconciliation, monthly financial statement preparation, job cost analysis, cash flow forecasting, and management reporting.
Our Services are limited to the specific scope defined in each client's written Engagement Letter. No services will be performed outside the scope of that agreement without a written amendment signed by both parties.
2. Not a CPA Firm; No Professional Assurance
Jobcard Financial LLC is not a Certified Public Accounting (CPA) firm and is not registered with the California Board of Accountancy. We do not hold ourselves out as CPAs, and we are not licensed to provide CPA services including audits, reviews, compilations with CPA attestation, or any other services that require CPA licensure.
Financial statements, reports, and other deliverables prepared by Jobcard Financial are not audited, reviewed, or compiled in accordance with AICPA standards (including Statements on Standards for Accounting and Review Services, or SSARS). Our deliverables are prepared solely for internal management purposes and do not carry any form of professional assurance or attestation.
While we exercise reasonable care and diligence in preparing financial information, we do not warrant that any deliverable is free from errors, omissions, or inaccuracies. Clients are responsible for reviewing all deliverables and notifying us of any discrepancies.
3. No Tax, Legal, or Investment Advice
Jobcard Financial does not provide tax preparation, tax planning, tax advisory, legal advice, investment advice, or business consulting services. No information provided by Jobcard Financial, whether through this website, our deliverables, or verbal communications, should be construed as tax, legal, or investment advice.
Bookkeeping entries, journal entries, and chart of accounts decisions may have tax implications. Clients are solely responsible for consulting with a qualified tax professional (CPA, Enrolled Agent, or tax attorney) regarding all tax-related matters, including but not limited to tax return preparation, estimated tax payments, tax planning, and the tax consequences of transactions.
No information provided by Jobcard Financial is intended to be used, and cannot be used, for the purpose of avoiding federal, state, or local tax penalties.
4. Services Expressly Excluded
The following services are expressly outside the scope of Jobcard Financial's offerings and are not provided under any circumstance:
- Tax return preparation and filing
- Tax planning, tax strategy, or tax advisory services
- Audit, review, or compilation services with CPA attestation
- Forensic accounting or fraud investigation
- Legal advice or representation
- Investment advice, financial planning, or securities advisory
- IRS, FTB, or state tax authority representation or audit defense
- Sales tax, excise tax, or payroll tax consulting
- Actuarial services or insurance advisory
- Internal control design, testing, or attestation
Clients requiring any of the above services should engage appropriately licensed professionals.
5. No Client Relationship from Website Use
Accessing this website, submitting a form, or communicating with Jobcard Financial does not create a bookkeeper-client, advisor-client, or any other professional relationship. A formal engagement relationship is established only upon execution of a written Engagement Letter by both parties.
Information provided on this website, including descriptions of services, pricing, and general financial concepts, is provided for general informational purposes only and does not constitute professional advice. Visitors should not act on any information contained on this website without first engaging appropriate professional counsel.
6. Third-Party Reliance Disclaimer
All financial statements, reports, and deliverables prepared by Jobcard Financial are prepared solely for the internal use of the named client. They are not prepared for, and should not be relied upon by, any third party, including but not limited to lenders, investors, creditors, bonding companies, government agencies, auditors, attorneys, or prospective purchasers.
Jobcard Financial assumes no responsibility or liability to any third party that obtains, reviews, or relies upon any deliverable prepared by the Company, whether or not such access was authorized by the client. Third parties requiring reliable financial information should obtain independently prepared financial statements with appropriate CPA attestation (audit, review, or compilation).
7. Client Responsibilities
Clients are responsible for providing complete, accurate, and timely financial documentation and source records. Jobcard Financial relies on information provided by the client and is not responsible for verifying the accuracy, completeness, or authenticity of client-provided data.
Clients bear sole responsibility for maintaining internal controls, fraud prevention measures, and the security of their financial systems. Jobcard Financial's Services do not constitute fraud detection, internal control testing, or security assurance. We are not responsible for unauthorized transactions, fraud, embezzlement, or misappropriation of assets unless directly caused by Jobcard Financial's own gross negligence or willful misconduct.
Clients are responsible for maintaining independent backup copies of all financial records and source documents.
8. Errors and Omissions
Despite reasonable care and diligence, errors and omissions may occur in the preparation of financial records, reports, and deliverables. Jobcard Financial will correct identified errors upon discovery at no additional charge, provided the error was caused by the Company.
Jobcard Financial is not responsible for errors resulting from incomplete, inaccurate, or untimely information provided by the client, or from changes to tax law, accounting standards, or regulatory requirements that occur after the preparation date of a deliverable.
Jobcard Financial maintains professional liability (Errors & Omissions) insurance. Insurance coverage is subject to policy terms, conditions, and exclusions.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Jobcard Financial's total aggregate liability for any and all claims arising out of or related to the Services, this website, or these Terms shall not exceed the total fees paid by the client to Jobcard Financial during the twelve (12) months immediately preceding the event giving rise to such claim.
In no event shall Jobcard Financial be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost business opportunities, loss of data, business interruption, or reputational harm, regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if Jobcard Financial has been advised of the possibility of such damages.
Nothing in these Terms shall limit or exclude liability for fraud, willful misconduct, gross negligence, or any liability that cannot be limited or excluded under California law (California Civil Code Section 1668).
10. Data Access and QuickBooks Integration
In the course of providing Services, Jobcard Financial will access client financial data through authorized connections to accounting software (including QuickBooks Online and QuickBooks Desktop), bank feeds, and other financial platforms as agreed upon in the Engagement Letter. All access is limited to the scope necessary to perform the contracted Services.
Clients authorize Jobcard Financial to access, view, modify, and manage financial records within the agreed scope. Jobcard Financial will not access client data outside the scope of contracted Services or share client data with unauthorized third parties.

11. Data Retention
Jobcard Financial retains client financial records and work product for a period consistent with IRS record retention guidelines (generally seven years) unless a different retention period is specified in the Engagement Letter or required by applicable law.
Upon termination of the engagement, Jobcard Financial will return or make available all client data and work product in accordance with the Engagement Letter. Clients are responsible for maintaining independent backup copies of all financial records during and after the engagement period.
12. Communication Security
Email and other electronic communications may not be secure or confidential. Jobcard Financial uses commercially reasonable security measures but cannot guarantee the absolute security of electronic transmissions. Clients should not transmit highly sensitive information (passwords, banking credentials, Social Security numbers) via unencrypted email.
Jobcard Financial is not responsible for unauthorized interception of electronic communications except where such interception is caused by the Company's own negligence.
13. Engagement Letter Controls
The terms and conditions of each client's signed Engagement Letter constitute the governing agreement for Services rendered. In the event of any conflict between these Terms of Service and a signed Engagement Letter, the Engagement Letter shall control.
No information on this website, in marketing materials, or in verbal communications shall override or modify the terms of a signed Engagement Letter.
14. Termination
Either party may terminate the engagement in accordance with the terms of the Engagement Letter. Upon termination, Jobcard Financial will cease all Services, revoke access to client accounting systems, and return or make available all client data and work product within thirty (30) days.
Jobcard Financial is not responsible for bookkeeping gaps, financial reporting delays, or other issues arising after the effective date of termination.
15. Testimonials and Marketing Claims
Any client testimonials, case studies, or performance metrics displayed on this website reflect the individual experiences of specific clients. Results may vary and are not guaranteed for other clients. Testimonials do not constitute CPA attestation, endorsement of specific financial outcomes, or guarantee of results.
Sample reports, demo data, and illustrative examples displayed on this website use fictional business names and fabricated financial data for demonstration purposes only.
16. Website Disclaimer
This website is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied. Jobcard Financial does not warrant that the website will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
Jobcard Financial is not responsible for any third-party content, links, services, or resources referenced on this website. Links to third-party websites are provided for convenience only and do not constitute endorsement.
17. Governing Law and Dispute Resolution
These Terms of Service and any disputes arising from or relating to these Terms, the Services, or this website shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
Any dispute, claim, or controversy that cannot be resolved through good-faith negotiation shall be resolved through binding arbitration administered in Los Angeles County, California, in accordance with the rules of the American Arbitration Association. Each party shall bear its own costs and attorney's fees unless the arbitrator determines otherwise.
18. Indemnification
Client agrees to indemnify, defend, and hold harmless Jobcard Financial LLC, its members, managers, employees, agents, and contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) Client's breach of these Terms or the Engagement Letter; (b) Client's provision of inaccurate, incomplete, or misleading information; (c) any third party's reliance on deliverables prepared by Jobcard Financial at Client's direction or with Client's authorization; or (d) Client's violation of any applicable law or regulation.
19. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, shall be severed. The remaining provisions shall continue in full force and effect.
20. Changes to These Terms
Jobcard Financial reserves the right to update or modify these Terms of Service at any time. Material changes will be posted on this page with an updated effective date. Continued use of the website or Services after changes are posted constitutes acceptance of the updated Terms.
